Status of Claims Process

On July 26, 2024, the Ontario Superior Court of Justice approved a distribution of residual settlement funds to certain approved claimants. To be eligible for a residual payment you must have been an approved End User claimant that was issued and successfully deposited a payment(s) totaling greater than $250.00.

The court-approved residual payments were sent to class members on November 6, 2024. Residual payments must be deposited within six months of receipt. The deadline to deposit residual funds is April 6, 2025, following which residual distribution cheques will become stale-dated. Please be advised that these payments represent the last payment that will be issued to class members from the class action.

The Settlements and Claims Administration Process

This case has been fully resolved through Court-approved settlement agreements reached with all of the defendants on behalf of the class totaling $7,535,000.

A four-month long notice and claims process was undertaken.  That claims process concluded on May 22, 2019. Individuals and businesses who made successful claims for lawnmowers purchased for their own use received their cheques in May, 2020. Upstream purchasers of lawnmowers for resale who made successful claims received their cheques in July, 2020.

 

What is this Case About?

This class action was brought on behalf of all Canadians who purchased a lawnmower containing a gas combustible engine of 30 horsepower or less, that was designed, manufactured and/or sold by any of the defendant companies between January 1, 1994 and December 31, 2012. It alleged that the defendants participated in an unlawful conspiracy to raise, fix, maintain or stabilize the price of lawnmowers in Canada, unduly lessen competition, and/or to conduct business contrary to the Competition Act and the Consumer Packaging and Labelling Act.

Our lawyers led a national consortium that sought to recover the overcharge that class members paid for lawnmowers during the period of January 1, 1994 to December 31, 2012.
